🛡️ PARTICIPANT RELEASE OF LIABILITY & ACCIDENT WAIVER

By entering and using the facilities at Swing N' Smash Golf Inc., I acknowledge and accept the terms of this release of liability & accident waiver.

In consideration of the opportunity to use the Swing N’ Smash Golf Inc. facility/premises, the building, golf simulators, and related equipment including golf balls and components, I hereby agree to the following:

1. Assumption of Risk

I understand that participating in golf simulator activities involves certain risks, including but not limited to physical injury, property damage, and equipment failure. I voluntarily accept and assume all such risks.

2. Waiver of Liability

In consideration of being allowed to use the facility, I, on behalf of myself and any heirs or legal representatives, release and hold harmless Swing N’ Smash Golf Inc., its owners, employees, contractors, and affiliates from any and all claims, liabilities, or expenses that may arise from my participation, including those resulting from negligence.

3. Indemnification

I agree to indemnify and cover any damages, costs, or legal fees resulting from injuries, property damage, or claims caused by my own actions while using the facility.

4. Health Declaration

I confirm that I am in good physical health and free of any medical condition that could put me or others at risk while playing. I accept full responsibility for any injury or medical costs I may incur. I also accept responsibility for any property damage caused by my negligence, misuse, or failure to follow safety protocols.

5. Agreement to Follow Rules

I agree to follow all instructions, rules, and safety guidelines set by Swing N’ Smash Golf Inc. I understand that failure to comply may result in removal from the premises without a refund.

6. For Minors

If I am signing on behalf of a minor, I confirm that I am the minor’s legal parent or guardian, and I have the authority to do so. I also accept full responsibility for the minor’s participation and agree to indemnify Swing N’ Smash Golf Inc. for any resulting claims.

7. Photography & Media Release

I give permission for photos or video recordings taken of me during my visit to be used for promotional purposes by Swing N’ Smash Golf Inc., including on their website and social media platforms. I understand I will not receive any compensation for this.

8. Governing Law

I understand that this agreement is governed by the laws of the Province of Ontario, and that any legal disputes will be resolved in the appropriate Ontario courts. If Swing N’ Smash Golf Inc. must incur legal costs to enforce this waiver, I agree to cover those costs.

9. Acknowledgment of Understanding

By proceeding, I confirm that I have read and fully understand this agreement. I understand that I am giving up significant legal rights and accepting full responsibility for my actions. I agree to this waiver freely and voluntarily, and acknowledge that this electronic agreement is legally binding just like a signed document.
